During our last IP/IT Practice group work session, Celine Eyers, General Counsel of ICE SA, proposed an alternative way for fighting against counterfeits. Counterfeiters usually locate their activities in physical locations (warehouse, factory, shops, etc) but are not the landlords of such places. The idea is to inform the landlords that they are participating to IP infringement and to urge them for helping the cease. If landlords deny or do not participate, their joint and several liability with counterfeiters could be held before the competent court of Justice. Celine Eyers explained several cases around the world and provided the audience with some tips and tricks.
